KUALA LUMPUR: Selangor state executive councilor and PKR Youth chief Nik Nazmi Nik Ahmad filed a civil suit against Attorney-General Tan Sri Abdul Gani Patail and the government at the High Court here today.
Nik Nazmi, 33, who is Seri Setia state assemblyman, claimed "malicious prosecution" and "misfeasance in public office" by Gani.
He said to charge him for the second time and to appeal against the decision of a High Court, in his first case, was "malicious prosecution".
Nik Nazmi said Gani had prosecuted a charge against him, a day after, a Sessions Court had confirmed his acquittal.
He said Gani had prosecuted under the same charge of a previous case, although the Court of Appeal had decided the section, under which, he was charged is invalid.
He said Gani had filed an appeal after the Sessions Court set aside his charge based on the decision of the Court of Appeal.
Nik Nazmi said he was charged for the second time as he is a PKR politician while organisers of other assemblies, which did not comply with the Peaceful Assembly Act 2012 (PAA) were not charged.
He said the prosecution on the second charge and appeal was made despite the Court of Appeal's decision being still valid as the appeal in the Federal Court was not heard yet.
Nik Nazmi is seeking RM80,000 special damages, general, exemplary and aggravated damages, costs, interests and other reliefs deemed fit and proper by the court.
