Company secretary pleads not guilty to false SSM financial statements

A company secretary faces charges for submitting false financial statements to SSM, with a potential 10-year jail term and RM3 million fine.

KUALA LUMPUR: A company secretary has pleaded not guilty to submitting false financial statements to the Companies Commission of Malaysia (SSM).

Mohd Khairul Amini A. Ramli, 54, was charged at the Sessions Court here today.

The charge relates to making false statements in the financial report of Xperanti IOT (M) Sdn Bhd for the year ended 31 December 2022.

The document falsely claimed the statements were circulated to company members on 28 November 2023.

The alleged offence occurred at Menara SSM@Sentral, KL Sentral, on 29 November 2023.

If convicted under Section 593(b) of the Companies Act 2016, he faces up to 10 years in prison, a fine of up to RM3 million, or both.

Judge Siti Shakirah Mohtarudin granted bail of RM10,000.

The case has been set for mention on 12 February.

SSM officer Farieza Hazreen Salehuddin prosecuted the case.

The accused was represented by lawyer Muhammad Amir Akmal Ahmad Shukri.
