Federal Court rejects Semantan Estate’s appeal in Duta Enclave land dispute

PUTRAJAYA: The Federal Court has dismissed Semantan Estate (1952) Sdn Bhd’s application for leave to appeal in its long-running land dispute with the government.

This rejection means the Court of Appeal’s decision favouring the government stands final.

The company cannot proceed with its Federal Court appeal after failing to obtain required leave.

A three-member bench led by Chief Judge of Malaya Tan Sri Hasnah Mohammed Hashim ruled the company failed to meet legal threshold requirements.

The court dismissed the application without costs.

Justice Hasnah fixed November 17 for case management before High Court judge Roslan Mat Nor.

The judge will set an early hearing date for compensation assessment.

The Court of Appeal had ruled on June 24 that Semantan Estate is not entitled to the land title.

However, the court held the company is entitled to adequate compensation based on the land’s 1956 value.

The government took possession of the 263.272-acre Duta Enclave land in 1956.

The prime land in Jalan Duta houses several government buildings and facilities.

These include the National Hockey Stadium and Malaysian Institute of Integrity.

The National Archives and Kuala Lumpur Syariah Court are also located there.

The Inland Revenue Board building and MACC Academy complete the government complex.

The disputed property represents one of Kuala Lumpur’s most valuable land parcels. – Bernama
