Kuala Lumpur High Court sets Nov 13 to decide on Na’imah Abdul Khalid’s bid to intervene in MACC’s Jersey assets prohibition order application
KUALA LUMPUR: The High Court here will decide on November 13 whether Toh Puan Na’imah Abdul Khalid can intervene in the Malaysian Anti-Corruption Commission’s application to freeze assets in Jersey.
Judge Datuk Muhammad Jamil Hussin fixed the date after hearing submissions from both parties during today’s proceedings.
Deputy public prosecutors Mahadi Abdul Jumaat and Siti Amira Muhammad Ali represented the MACC while lawyers Datuk Dr Gurdial Singh Nijar and Abraham Au appeared for Na’imah.
Mahadi argued that Na’imah failed to demonstrate any legal interest in the assets or her role in the four companies involved.
The prosecution seeks a prohibition order to maintain the status quo during investigations into assets worth USD157.5 million and GBP85 million located in the British crown dependency.
Mahadi emphasized that the MACC would withdraw the application if no offences are detected during their investigation.
Abraham countered that the public prosecutor’s affidavit clearly indicated the prohibition order application concerned assets owned by the intervener.
The MACC filed the ex parte application on June 25 alleging the assets were acquired in Malaysia but not declared to the Inland Revenue Board.
This marks the third such application by the MACC following similar bids involving assets in the United Kingdom and Singapore.
MACC chief commissioner Tan Sri Azam Baki previously revealed eight investigation papers were initiated based on fresh information from foreign agencies.
The information indicated that assets linked to the late Tun Daim Zainuddin, his family and proxies had not been declared during 2023 investigations. – Bernama
