SHAH ALAM: The ex-husband of famous singer Ziana Zain, Armin Zaharin Ahmad Zambri will file a petition of appeal containing the reasons why the High Court should set aside his conviction and the eight months jail sentence for caning his son, after obtaining the records of appeal from the Magistrateâs Court.
Lawyer Amir Farid Mohd Nawawi, representing Armin Zaharin, 55, said the petition of appeal would be filed as soon as the records of appeal containing the grounds of judgment were received in line with the provisions under the Criminal Procedure Code.
Meanwhile, deputy public prosecutor Shukor Abu Bakar told reporters that the court set Jan 13 next year for the case management of the appeal.
âThe date (Jan 13) is to check whether Armin Zaharin has filed the appeal petition,â he said when met after the case management before High Court senior assistant registrar Nur Azizah Jaafar.
The appeal will be heard before Judge Datuk Noorin Badaruddin.
Armin Zaharin, 55, was appealing against the conviction and sentence meted out by Magistrate Sabreena Bakar @ Bahari last Sept 28.
She meted out the sentence after finding Armin Zaharin guilty of intentionally causing injuries and bruises on the hands of his nine-year-old son using a cane at a house in Denai Alam, Shah Alam between 8 pm and 10.30 pm on Feb 24, 2018.
The former chief steward was charged under Section 323 of the Penal Code which provides for a maximum jail term of one year or a fine of RM2,000 or both, if convicted.
Sabreena, however, allowed the execution of Armin Zaharinâs sentence to be postponed until the appeal process is completed but raised the bail amount from RM5,000 to RM8,000.
Armin Zaharin was arrested on March 2, 2018, after Ziana, whose real name is Siti Roziana Zin, 52, lodged a police report on Feb 27.
The couple, who married in 1998, is blessed with three sons and a daughter aged between 11 and 20.
They were legally divorced in July 2018. -Bernama
