AGC bantah permohonan peguam Albert Tei cabar arahan SPRM

Jabatan Peguam Negara bantah permohonan peguam untuk semak kehakiman dua arahan SPRM terhadap ahli perniagaan Albert Tei, dakwa arahan itu sebahagian proses siasatan.

KUALA LUMPUR: Jabatan Peguam Negara (AGC) membantah permohonan seorang peguam untuk mendapatkan kebenaran memfailkan semakan kehakiman.

Permohonan itu bertujuan mencabar dua arahan Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) terhadap anak guamnya, ahli perniagaan Albert Tei.

Peguam Kanan Persekutuan Shamsul Bolhassan berhujah arahan SPRM itu tidak tertakluk kepada semakan kehakiman.

Beliau berkata arahan di bawah Seksyen 30(1)(a) dan (b) Akta SPRM 2009 merupakan pelaksanaan fungsi dalam proses siasatan jenayah.

Peguam N. Surendran, yang mewakili peguam Mahajoth Singh, pula berkata arahan itu tidak sah serta tidak boleh dikuat kuasa.

Beliau mendakwa SPRM melanggar perlindungan statutori terhadap komunikasi terlindung antara peguam dan anak guam.

Mahkamah Tinggi menetapkan 28 Jan ini untuk memutuskan permohonan Mahajoth yang difailkan pada 9 Dis lepas.

Antara barangan yang diminta SPRM ialah telefon bimbit Tei dan dokumen berkaitan pembelian perabot serta pakaian.

SPRM juga meminta salinan perbualan WhatsApp antara Tei dan beberapa individu.
