Indonesian sentenced to 15 years’ jail for raping daughter

As a result of the rape, the victim, now 15, was found to be 30 to 32 weeks pregnant upon examination at Kinabatangan Hospital.

KOTA KINABALU: An Indonesian man was sentenced to 15 years in prison and 10 strokes of the cane by the Sandakan Sessions Court today (Tuesday) after pleading guilty to raping his biological daughter.

Judge Roslinda Razali handed down the sentence to the accused, who was charged under Section 376(1) of the Penal Code.

Based on the facts of the case, the incident was reported to have occurred at an oil palm plantation in Kinabatangan on April 27 last year, at around 10pm, while the victim was sleeping in her room.

According to Deputy Public Prosecutor Yuvan A/L Bharathan, the case came to light when the victim’s uncle, who works as a security guard, was informed of the incident. Upon learning about it, the uncle notified his supervisor before lodging a police report on Nov 10.

Police subsequently arrested the 36-year-old accused at a worker’s house at the same plantation on at 4.15pm that very day.

As a result of the rape, the victim, now 15, was found to be 30 to 32 weeks pregnant upon examination at Kinabatangan Hospital.

The accused, who was unrepresented by a lawyer, was sentenced to 15 years in prison, effective from his date of arrest.

Roslinda also ordered that the accused be referred to the Malaysian Immigration Department for deportation to his home country upon completing his prison sentence.
