Sungai Buloh PAS chief pleads not guilty to illegal assembly charge

Sungai Buloh PAS chief Zaharudin Muhammad pleads not guilty to participating in an illegal assembly during a Kampung Sungai Baru demolition operation last year.

KUALA LUMPUR: Sungai Buloh PAS chief Zaharudin Muhammad pleaded not guilty at the Magistrate’s Court here on Monday to a charge of participating in an unlawful assembly.

The 49-year-old, who is the son-in-law of PAS president Tan Sri Abdul Hadi Awang, is alleged to have committed the offence at Jalan Datuk Abdul Malik, Kampung Sungai Baru, between 10.50 am and 11.14 am on Sept 11, 2025.

He was charged under Section 145 of the Penal Code, which carries a maximum penalty of two years’ imprisonment, a fine, or both.

Deputy public prosecutor Wirna Arifin proposed bail of RM5,000 with one surety.

Defence lawyer Latheefa Koya requested a reduction, explaining her client is the sole breadwinner.

Magistrate Farah Nabihah Muhamad Dan then granted bail of RM2,000 with two sureties and fixed the next mention for Feb 24.

Latheefa also informed the court that her client had filed an originating summons in the High Court on Dec 31.

The summons seeks a declaration that Section 145 of the Penal Code is inconsistent with the constitutional right to freedom of assembly.

The charge relates to a gathering held to oppose an eviction notice during a demolition operation.

On Sept 11, several individuals were detained after former Dang Wangi police chief ACP Sulizmie Affendy Sulaiman was injured.

He sustained a head injury from an object thrown while managing the operation to cut electricity supplies.

The operation was carried out following a court order for the demolition of structures in the area.
