KUALA LUMPUR: A petrol station owner was fined RM30,000 by the Selayang Sessions Court here for selling RON95 petrol, which is a controlled item, to a vehicle bearing a Thailand registration number plate three months ago.
Judge Nor Rajiah Mat Zin handed down the sentence on Mohammad Naziruddin Abu Hassan, 61, after he pleaded guilty to the charge.
The court also ordered the accused to serve six months in jail if he failed to pay the fine. He paid the fine.
Mohammad Naziruddin, as a licence holder of scheduled controlled goods, namely petrol and diesel, was charged with failing to comply with the supply control instructions by selling 48.78 litres of RON95 petrol to the vehicle, which violated Regulation 12A of the Control and Supply Regulations 1974.
The offence was committed at a petrol station at the rest and recreation area of the North-South Expressway (northbound) in Rawang, Selangor, at 9.16 am on Jan 1.
The charge was framed under Rule 21(1) of the same regulations and is punishable under Section 22 (1) of the Control of Supplies Act 1961, which carries a maximum fine of RM1 million or an imprisonment of up to three years or both, and for a second or subsequent offence can be fined up to RM3 million or a maximum imprisonment of five years or both, upon conviction.
Deputy public prosecutor Siti Fatimah Hannah Abd Wahab and Domestic Trade and Cost of Living Ministry prosecuting officer Nor Wahidah Muhammad appeared for the prosecution, while the accused was represented by Muhammad Syahmi Akif Jamili.
