IPOH: M. Indira Gandhi, the estranged wife of a Muslim convert, wants the Inspector-General of Police Tan Sri Khalid Abu Bakar, to execute the High Court order on Sept 12 to arrest her former husband and retrieve her daughter.
"Why is the IGP taking such a long time to carry out the order ... despite (us) winning all stages of the court cases since 2009?" the kindergarten teacher said at a press conference here today.
Her lawyer, M. Kulasegaran, who was also present, said in all sense of justice Attorney-General (Tan Sri Abdul Gani Patail) should discontinue the IGP's appeal to the Court of Appeal for a stay order.
Last Friday, the High Court rejected the application made by senior federal counsel Noor Hisham Ismail for a stay order.
Kulasegaran said on Monday the AG had served on his law firm a notice of appeal to the Appeal Court over the stay order.
"Although all parties have an inherent right to appeal against a court decision, it must be pursued prudently with public interest in mind by the AG. If the AG does not proceed with the appeal, it would do justice to Indira Ghandi as her husband has yet to purge his contempt of court," he added.
Kulasegaran said an appeal would only cause unnecessary mental torture and anguish to the mother besides sending a message to the IGP and other public servants that court orders are open to question despite conclusive determination by the courts.
He added that her former husband had exhausted all legal avenues and has no further appeals.
The High Court made a landmark decision last Friday in granting Indira Gandhi the mandamus order to compel the IGP to arrest Muhammad Riduan Abdullah (formerly K. Pathmanathan) and return the youngest child, Prasana Diska, six, to her.
Meanwhile, police said the Khalid is awaiting directive from Gani to make the arrest.
