Presiden Mahkamah Rayuan tarik diri dengar permohonan Bersatu cabar keputusan Speaker Johari Abdul berhubung empat kerusi Parlimen Sabah

PUTRAJAYA: Presiden Mahkamah Rayuan menarik diri daripada mendengar permohonan Parti Pribumi Bersatu Malaysia (Bersatu) untuk mencabar keputusan Speaker Dewan Rakyat.

Datuk Abu Bakar Jais memutuskan untuk menarik diri kerana mengenali peguam Bersatu, Tan Sri Azhar Azizan Harun, selama lebih 30 tahun.

Beliau mengetuai panel tiga hakim Mahkamah Persekutuan yang mendengar permohonan itu.

Panel itu menetapkan esok sebagai hari pengurusan kes bagi menetapkan tarikh pendengaran baharu.

Turut bersidang ialah Hakim Besar Sabah dan Sarawak Datuk Azizah Nawawi dan Hakim Mahkamah Persekutuan Tan Sri Nallini Pathmanathan.

Abu Bakar berkata beliau percaya isu itu tidak akan menimbulkan konflik kepentingan awam.

Bagaimanapun, beliau meminta kedua-dua pihak menyuarakan pendapat berhubung perkara itu.

Peguam keempat-empat Ahli Parlimen terbabit, Datuk Firoz Hussein Ahmad Jamaluddin, memaklumkan anak guamnya agak keberatan jika Abu Bakar terus mendengar permohonan.

Permohonan semakan kehakiman difailkan pada 17 April 2023 oleh Naib Presiden Bersatu Datuk Seri Dr Ronald Kiandee dan Datuk Kapten (B) Muhammad Suhaimi Yahya.

Mereka menamakan Speaker Tan Sri Johari Abdul serta empat Ahli Parlimen Sabah sebagai responden.

Keempat-empat Ahli Parlimen itu ialah Datuk Armizan Mohd Ali (Papar), Khairul Firdaus Akbar Khan (Batu Sapi), Datuk Jonathan Yasin (Ranau) dan Datuk Matbali Musah (Sipitang).

Bersatu memohon perintah untuk membatalkan keputusan Johari melalui surat bertarikh 16 Januari 2023.

Surat itu menyatakan keempat-empat Ahli Parlimen telah memberikan penjelasan dan mengesahkan tiada kekosongan kerusi.

Keputusan itu berdasarkan tafsiran Perlembagaan Gabungan Rakyat Sabah (GRS) serta Perstitusi Bersatu.

Parti itu turut memohon deklarasi bahawa Ahli Parlimen terbabit telah berhenti menjadi Ahli Dewan Rakyat mengikut Perkara 49A Perlembagaan Persekutuan.

Bersatu juga memohon perintah supaya Johari mengesahkan berlakunya kekosongan luar jangka bagi kesemua kerusi Parlimen terbabit.

Pada 16 November 2023, Mahkamah Tinggi menolak permohonan Bersatu untuk mendapatkan kebenaran bagi memulakan semakan kehakiman.

Rayuan parti itu turut ditolak oleh Mahkamah Rayuan pada 4 Ogos lepas. – Bernama
