Ismanira’s husband lashed out in court at an officer after the court sentenced his wife to five years in prison.
PETALING JAYA: “May Allah curse you. You just wait, bald guy,” said Ismanira Abdul Manaf’s husband, Zaim Ikhwan Zahari, while pointing his finger at the investigating officer, deputy Superintendent Mohd Hafizee Ismail.
His angry outburst came after the Sessions Court rejected lawyer Haresh Mahadevan’s request to postpone his wife’s prison sentence.
Zaim Ikhwan, visibly unable to control his emotions, was restrained and calmed down by several family members, including his parents, before being escorted out of the courtroom, Berita Harian reported.
Earlier, lawyer Haresh had asked the court to delay the five-year jail sentence imposed on Ismanira after she was found guilty of neglecting her son, the late Zayn Rayyan Abdul Matin, two years ago.
He said the defense would file an appeal against the decision at the High Court today.
The Sessions Court had sentenced Ismanira to five years in prison after finding her guilty of neglecting her son, who was autistic. Judge Dr Syahliza Warnoh ordered that the sentence begin from the date of conviction.
The court also instructed Ismanira to sign a two-year good behaviour bond with a local surety and a bail of RM3,000. She was also ordered to perform 120 hours of community service within six months after completing her prison term.
On July 21, the court had ordered Ismanira to enter her defense, while her husband, Zaim Ikhwan, was acquitted of the same charge.
The court ruled that the prosecution had established a prima facie case against Ismanira but failed to do so for her husband.
According to the amended charge, Ismanira, as the person responsible for the care of six-year-old Zayn Rayyan, was accused of neglecting him in a manner likely to cause physical injury.
The offense allegedly took place around Block R of the Idaman Apartment in Damansara Damai and near a nearby river between 12 p.m. on December 5 and 9:55 p.m. on December 6, 2023.
The charge was framed under Section 31(1)(a) of the Child Act 2001, read together with Section 34 of the Penal Code, which carries a maximum penalty of 20 years in prison, a RM50,000 fine, or both.
The prosecution was led by Deputy Public Prosecutors Raja Zaizul Faridah Raja Zaharudin, Aqharie Durranie Aziz, and Nur Sabrina Zubairi, while the accused were represented by lawyers Haresh Mahadevan, Ramzani Idris, and Lavanesh Haresh.
