The Online Safety Act 2025 strengthens MCMC’s role as primary regulator, with a new committee providing advisory support and technical analysis.
KUALA LUMPUR: The Malaysian Communications and Multimedia Commission (MCMC) remains the primary and sole regulator under the Online Safety Act 2025.
Minister in the Prime Minister’s Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said confirmed the new Online Safety Committee will not diminish MCMC’s authority.
“Act 866 strengthens MCMC’s mandate to lead investigations, enforcement and action against platforms that fail to protect users,” she said.
Azalina clarified that MCMC’s powers remain intact while the committee provides strategic analysis and technical data.
“The checks-and-balances mechanism is strengthened to ensure decisions are transparent, evidence-based and do not undermine freedom of expression,” she stated after chairing the Pro Tem Online Safety Committee meeting at the Asian International Arbitration Centre.
The Pro Tem Committee serves as a coordinating and advisory platform to identify online risks and harmful trends.
It will conduct technical studies and coordinate consultations with industry, academia and civil society groups.
Before full enforcement, the committee will set strategic direction and governance frameworks for implementation.
Once the Act comes into force, former Chief Judge of Malaya Tan Sri Hasnah Mohammed Hashim will chair the committee.
Today’s meeting addressed AI-related threats including deepfakes and discussed the committee’s draft Terms of Reference.
Engagement sessions were held with ministries, agencies and civil society representatives including Article 19 and the Centre for Independent Journalism.
“The MADANI Government remains committed to building a safe, ethical and balanced digital ecosystem,” Azalina added.
The Legal Affairs Division will continue strengthening the legal framework to keep pace with global technological developments.
