171 locals released after court rejects remand in health club raid

Kuala Lumpur court rejects remand for 171 locals arrested in health club raid for suspected immoral activities, citing lack of victim confessions

KUALA LUMPUR: A total of 171 local individuals arrested during a raid at a health club suspected of hosting immoral activities were released after the court rejected their remand application.

Kuala Lumpur police chief Datuk Fadil Marsus said investigations under Section 377 and Section 372 of the Penal Code could not proceed without victim confessions.

“No one admitted to being a victim of exploitation, as in cases of exploitation, prostitution, or unnatural sex, there must be a victim,” he told reporters during the Kampung Sungai Baru redevelopment project groundbreaking ceremony.

“Since none of them confessed to being a victim, the case cannot continue.”

He added that only foreign nationals were remanded for two days while all locals were released due to insufficient evidence.

Police are considering collaboration with other agencies including Syariah law enforcers and may provide counselling sessions for those involved.

“Currently, we are requesting that they attend rehabilitation programmes and awareness talks,” Fadil said.

“Unless the laws are amended, this issue will persist and worsen.”

Minister in the Prime Minister’s Department (Religious Affairs) Datuk Dr Mohd Na’im Mokhtar stressed that immoral activities contradict religious teachings and MADANI values.

“This is a serious moral offence, not only from a legal perspective but also from a religious one—it is absolutely unacceptable,” he said.

He confirmed investigation under Section 25 of the Syariah Criminal Offences Act (Federal Territories) 1997 and Section 47 for attempted sodomy.

Mohd Na’im said prevention and enforcement efforts would continue through JAKIM and JAWI.

Last Friday, 17 civil servants were among 208 people arrested in a Chow Kit health club raid for suspected homosexual activities.

Police confiscated condoms and other items believed used for immoral purposes during the operation. – Bernama
