The High Court in Seremban grants ad interim injunctions to restrain six plaintiffs from holding DKU meetings amid an ongoing dispute.
SEREMBAN: The High Court here today granted ad interim injunctions against six plaintiffs in an ongoing dispute involving the Negeri Sembilan Dewan Keadilan dan Undang (DKU), restraining them from, among other actions, convening or holding any DKU meeting, including the Special Sitting that had been scheduled for today.
Judge Roz Mawar Rozain granted the injunctions upon an application by DKU Secretary Raja Norazli Raja Nordin, and the DKU, named the first and second defendant, respectively.
An ad interim injunction is a temporary court order intended to preserve the status quo until the court is able to hear and determine the matter in greater detail.
The six plaintiffs are Datuk Mubarak Thahak, Undang of Luak Jelebu Datuk Maarof Mat Rashad, Undang of Luak Johol Datuk Muhammed Abdullah, Undang of Luak Rembau Datuk Abdul Rahim Yasin, Tunku Besar of Tampin Tunku Syed Razman Tunku Syed Idrus Al-Qadri, and Shahbandar of Sungai Ujong Datuk Seri Badarudin Abdul Khalid.
In a statement issued on behalf of the defendants, it was stated that the court order prohibits the plaintiffs, whether acting personally or through any servant, agent, nominee or appointee, from convening or holding any DKU meeting.
The plaintiffs are also restrained from suspending, removing, replacing or otherwise interfering with Raja Norazli in the performance of his duties and functions as Secretary of the DKU, pending further court proceedings.
In addition, the plaintiffs are prohibited from establishing or empowering any committee, person or body to assume the powers and functions of the DKU secretary, as well as from taking, making or implementing any decisions relating to the administration, governance, proceedings and affairs of the DKU.
The order further restrains the plaintiffs from “otherwise taking any step that alters or interferes with the status quo of the DKU as it stood immediately before May 21,” according to the statement.
The injunctions will remain in force pending the hearing and determination of issues relating to jurisdiction and justiciability, and thereafter until further order of the court.
With the injunctions in place, the plaintiffs are barred from removing Raja Norazli as DKU secretary, conducting any affairs on behalf of the DKU, or issuing press statements concerning matters related to the body.
Raja Norazli and the DKU were represented by a legal team comprising lawyers Steven Thiru, David Dinesh Mathew, Shafrin Halim, Gregory Das and Gurjeevan Singh.
The plaintiffs were represented by lawyers Awang Armadajaya, Datuk Rhiza Ghazi and Asmawi Ismail, while the Negeri Sembilan state government was represented by State Legal Adviser Datuk Muzalmah Mustapha Kamal and Assistant State Legal Adviser Aala’uddin Baharom.
