Sungai Buloh PAS chief pleads not guilty to illegal assembly charge

Sungai Buloh PAS chief Zaharudin Muhammad pleads not guilty to joining an illegal assembly during a Kampung Sungai Baru eviction operation last year

KUALA LUMPUR: Sungai Buloh PAS chief Zaharudin Muhammad pleaded not guilty in the Magistrate’s Court here today to a charge of joining an illegal assembly.

Zaharudin, 49, was charged alongside seven others for participating in the gathering to oppose an eviction notice process at Kampung Sungai Baru.

The son-in-law of PAS president Tan Sri Abdul Hadi Awang is accused of committing the offence at Jalan Datuk Abdul Malik between 10.50am and 11.14am on 11 Sept 2025.

The charge is framed under Section 145 of the Penal Code, which carries a maximum penalty of two years’ imprisonment, a fine, or both.

Deputy Public Prosecutor Wirna Arifin offered bail at RM5,000 with one surety, but lawyer Latheefa Koya requested a reduction, citing her client as the family’s sole breadwinner.

Magistrate Farah Nabihah Muhamad Dan allowed bail at RM2,000 with two sureties and set 24 Feb for mention of the case.

Earlier, Latheefa informed the court that Zaharudin had filed an originating summons in the High Court on 31 Dec last year.

He is seeking a declaration that the use of Section 145 of the Penal Code against him is inconsistent with Article 10(1)(b) of the Federal Constitution.
