MCMC implements ‘Deeming Provision’ (Section 46A) to regulate platforms like WhatsApp, TikTok, and Facebook
PETALING JAYA: Major social media and messaging platforms with at least eight million users in Malaysia will be automatically deemed registered from Jan 1, 2026, as regulators move to tighten oversight of large online platforms operating in the country.
The Malaysian Communications and Multimedia Commission (MCMC) said the move will be carried out through a dispensation of formalities under Section 46A of the Communications and Multimedia Act 1998, known as the Deeming Provision.
According to the regulator in a media statement, the step is intended to ensure that large-scale internet messaging and social media service providers operating in Malaysia comply with the country’s legal and regulatory framework in an orderly, consistent and effective manner.
The implementation is aligned with the licensing framework for internet messaging and social media service providers that came into force on Jan 1, 2025, aimed at strengthening platform accountability and compliance with Malaysian laws.
MCMC said the Deeming Provision will apply to service providers that meet the prescribed criteria, including WhatsApp, Telegram, Facebook, Instagram, TikTok and YouTube.
“This initiative also ensures that all platforms involved bear clearer responsibility for user safety, particularly in safeguarding children and families,” the commission said.
Service providers that are already registered as Applications Service Provider Class (ASP(C)) licensees will remain registered, with the Deeming Provision only taking effect after their existing registration period expires.
MCMC stressed that affected platforms will continue to operate their global services as usual, adding that the approach is consistent with international practices for regulating large-scale online platforms.
The commission said it will continue working closely with service providers and relevant law enforcement agencies to strengthen online safety measures, particularly for children and families, for the benefit of users in Malaysia.
