Prosecution opposes bid to expunge key witness statement in bribery case

The prosecution has objected to an attempt by a former minister’s aide to remove six paragraphs from a witness statement in his RM350,000 corruption trial.

KUALA LUMPUR: The prosecution has objected to an application to expunge six paragraphs from a key witness’s statement in the corruption trial of a former minister’s aide.

Deputy public prosecutor Hazel Tan Jia Qi argued the defence’s bid was premature as the witness had not yet been examined.

She said paragraphs three to eight outline the prosecution’s narrative for the RM350,000 charge against the accused.

The paragraphs include information on a 5% payment of a project’s value for a police tender.

Sayed Amir Muzzakkir Al Sayed Mohamad, former political secretary to ex-home minister Datuk Seri Hamzah Zainudin, faces three corruption charges totalling RM350,000.

His lawyer, Asmadi Hussin, argued the paragraphs were irrelevant and prejudicial to his client.

Judge Rosli Ahmad asked the defence to include the application in its submissions for a ruling later.

The trial will resume on July 22.

Sayed Amir Muzzakkir was charged last May with receiving bribes from Nexuscorpgroup Sdn Bhd’s managing director.

The money was allegedly to assist the company in obtaining a police tender worth over RM381 million.

He is also charged with soliciting the same bribe amount for the same purpose.

The charges fall under the MACC Act, carrying a maximum 20-year jail term and a heavy fine.
