High Court dismisses elderly woman’s Raub land ownership claim

Judge rules against 94-year-old plaintiff and orders RM10,000 costs; appeal to be filed following second dismissal.

TEMERLOH: The High Court today dismissed a lawsuit filed by a 94-year-old woman claiming ownership of an approximately 0.1-hectare land parcel in Mukim Gali, Raub.

Judge Roslan Mat Nor, in delivering the ruling, also ordered the plaintiff, A Sandramadi, to pay costs of RM10,000 to the Raub District Land Administrator and Pahang State Director of Land and Mines, who were named as the defendants.

“The Court based its ruling on the evidence and submissions from both parties. The costs order is not punitive, but rather compensates the defendants for their legal work in mounting a defence,” the judge said.

The plaintiff’s counsel, R Kengadharan, told the media that his client respects the Court’s decision and will file an appeal.  The defendants were represented by state assistant legal adviser Fathin Nadhirah Kasim.

In 2019, the mother of eleven had filed a claim in the same court regarding the ownership of the said land, which was dismissed.

She subsequently filed an appeal at the Court of Appeal in 2020, which ruled that the application had merit and remitted the case to the High Court here for a full trial.

Previously, the media reported that Sandramadi had alleged that a portion of her land had been encroached upon by a third party, but she continued to live on the property. – Bernama
