Saksi: Mesej perbualan pengadu dalam kes Ebit Lew yang dipadam gagal diperoleh

TENOM: Seorang saksi dalam perbicaraan kes pendakwah Ebit Irawan Ibrahim Lew, atau Ebit Lew, memberitahu Mahkamah Majistret di sini hari ini bahawa mesej perbualan dalam aplikasi WhatsApp telefon bimbit seorang wanita yang dipadam tidak berjaya diperoleh.

Juruanalisis Kanan Audio Video PDRM Latifah Abdul Aziz, 43, berkata hasil analisis beliau ke atas telefon bimbit milik pengadu dalam kes ini mendapati aplikasi WhatsApp adalah platform yang tidak menyimpan sebarang data.

“Oleh itu, sebarang mesej perbualan yang dipadam, data tersebut tidak boleh diperoleh,“ kata saksi pendakwaan ketujuh itu ketika pemeriksaan semula oleh Timbalan Pendakwa Raya Nor Azizah Mohamad.

Justeru itu, beliau tidak mempunyai pengetahuan sepenuhnya sama ada wujud mesej perbualan atau tidak di dalam aplikasi WhatsApp telefon bimbit tersebut.

Nor Azizah: Boleh kamu jelaskan kenapa kamu setuju dengan soalan (peguam) Ram Singh bahawa kemungkinan ada mesej yang mungkin telah dipadamkan.

Latifah: Mohon rujuk tangkap layar bertarikh 7 Ogos 2021 yang memaparkan kandungan perbualan daripada aplikasi WhatsApp, saya bersetuju sekiranya ada mesej yang mungkin dipadamkan tetapi saya tidak dapat pastikan.

Beliau berkata berdasarkan tangkap layar itu, tertera perkataan deleted messages dalam kandungan perbualan aplikasi WhatsApp, justeru ada kemungkinan mesej telah dipadam namun ia tidak dapat dipastikan sepenuhnya.

Lew, 38, berdepan 11 pertuduhan termasuk mengaibkan kehormatan seorang wanita berumur 40-an dengan menghantar perkataan dan gambar lucah ke nombor telefon mangsa melalui aplikasi WhatsApp antara Mac dan Jun 2021.

Dia didakwa mengikut Seksyen 509 Kanun Keseksaan yang membawa hukuman maksimum penjara lima tahun atau denda atau kedua-duanya, jika sabit kesalahan.
