Fahmi seeks bipartisan support for AG-PP separation bill

The government hopes to secure two-thirds majority backing from MPs, including the opposition, for the Constitutional (Amendment) Bill 2026 on separating the roles of the Attorney-General and Public Prosecutor.

PUTRAJAYA: The government hopes that the Constitutional (Amendment) Bill 2026 related to the separation of the roles of the Attorney-General and the Public Prosecutor will receive two-thirds majority support from MP, including from the opposition bloc, in order for the amendment to be passed.

Communications Minister and MADANI Government spokesperson Datuk Fahmi Fadzil said the bill is a major reform that emphasises separating the role of the Public Prosecutor from the executive branch, thereby strengthening the integrity of the country’s legal institutions.

“This is a major reform effort that the government and the Cabinet are committed to implementing. Engagement sessions and findings from the special select committee have been taken into account and the government is ready to bring it for debate and approval during this parliamentary session soon.

“If examined closely, this is what will ensure that the Public Prosecutor has powers that cannot be controlled or directed by any party for specific purposes. I believe this is a reform that should, must, and needs to be supported by everyone, taking into account the various views that have called for improvements to the bill,” Fahmi said at a post-Cabinet meeting press conference here today.

The reform is not political in nature, but rather for the future of the country and the strengthening of democratic institutions and the justice system, he added.

“MPs, whether from the government or opposition, must place the country, its democracy, and Parliament above political games, he said, adding that the Bill had nothing to do with politics.

Fahmi said the amendment demonstrates that the MADANI Government listens to all views and is willing to improve the bill regardless of political background.

He added that Minister in the Prime Minister’s Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said had considered various views raised earlier, with the bill going through committee processes and several amendments made to include issues raised by MPs.

Azalina had previously reported that among the proposed improvements were the appointment of the Public Prosecutor by the King on the advice of the Judicial and Legal Service Commission, without involving the Prime Minister or Cabinet.

Other proposals include a fixed seven-year term without renewal or reappointment, and a requirement for the Public Prosecutor to submit an annual report to Parliament to enhance transparency and accountability.

The Constitutional (Amendment) (No. 2) Bill 2026 on the separation of the roles of the Attorney General and Public Prosecutor was tabled for its first reading on February 23.
