High Court rejects father’s application to exhume UiTM Palapes cadet’s remains but orders public inquest and fresh police investigation into death.
SHAH ALAM: The High Court has dismissed an application to exhume the remains of a Universiti Teknologi Mara (UiTM) Reserve Officers’ Training Unit (Palapes) cadet who died during training last year.
Justice Roszianayati Ahmad ruled that neither exhumation nor a fresh post-mortem was necessary as Hospital Shah Alam had clearly established the cause of death.
She stated that the remaining dispute concerned how Muhammad Amir Rusyadi Muhamad Zaidi died and whether it was caused or accelerated by others’ actions or negligence.
The judge therefore allowed a public inquest to be conducted, noting that numerous affidavits contained allegations requiring full police investigation.
She ordered police to reopen investigations and assigned a new investigating officer from Bukit Aman to take over the case.
Roszianayati made the decision after examining the notice of motion and affidavit filed by Muhammad Zaidi Abdul Rahman, 53, against the Home Ministry and Attorney-General’s Chambers.
The court also dismissed three other applications by the father, including orders for exhumation and a new post-mortem by Kuala Lumpur Hospital forensic experts.
Another dismissed application sought to compel the original forensic expert to issue a post-mortem report within one month and provide a copy to the lawyer.
Reading her judgment grounds, Roszianayati said the main complaint concerned the cause of Muhammad Amir Rusyaidi’s death.
She noted that Hospital Shah Alam doctors had confirmed through affidavit that the cause was heat stroke with multiple organ failure.
The victim was admitted to hospital on November 10 and died on November 13, 2024, after various examinations and clinical tests.
Test results showed Muhammad Amir Rusyaidi died in a state of severe dehydration affecting multiple internal organs.
The doctor stated no physical injuries were found except for a red knee mark that didn’t contribute to his death.
The judge also noted confirmation from the deceased’s friends and Palapes trainers about intensive drills since November 9, 2024, aligning with medical findings. – Bernama
