Former armed forces chief Tan Sri Mohd Nizam Jaafar was charged in the Sessions Court today with four corruption-related offences involving more than RM3.7 million.
KUALA LUMPUR: Former armed forces chief Tan Sri Mohd Nizam Jaafar (pic) was charged in the Sessions Court today with four corruption-related offences involving more than RM3.7 million.
Mohd Nizam, 60, pleaded not guilty to two counts of abusing his position for gratification, one count of criminal breach of trust, and one count of accepting valuable items without consideration.
All the charges were read before Judge Rosli Ahmad and claimed trial.
Two of the charges involve offences of abusing his position as the Armed Forces’ Assistant Chief of Staff (Personnel Services) and chairman of the Armed Forces Welfare Fund (TKAT) executive committee to obtain gratification totalling RM552,481.90.
For the first charge, the accused is alleged to have approved the appointment of several companies to supply Hari Raya gift packages for TKAT in 2025.
The items included pelikat cloth, batik fabric, and multifunctional tools, with total contract values exceeding RM1.2 million, despite the accused having interests in the companies involved.
The second charge relates to the appointment of companies to supply bath towels and backpacks, with total contract values amounting to RM2.3 million, which allegedly resulted in financial benefits of RM285,000 to the accused.
Both offences were allegedly committed at the Defence Ministry on June 24, 2024, and were framed under Section 23(1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009.
In addition, Mohd Nizam faces a charge of criminal breach of trust for allegedly misusing RM3 million from the Armed Forces Welfare Fund (TKAT) by making an additional investment in a company without the approval of the TKAT Investment Committee.
The offence was allegedly committed on Oct 4, 2024, and was charged under Section 409 of the Penal Code.
For the fourth charge, the accused is alleged to have accepted RM200,000 in cash without consideration from a private company director, despite knowing that the individual had dealings related to his official duties at the time.
The offence was allegedly committed in March 2025.
The prosecution is led by Deputy Public Prosecutor Datuk Ahmad Akram Gharib, while Mohd Nizam is represented by lawyer Abdul Aziz Hamzah and his defence team.
The court granted bail of RM180,000 with one surety and fixed March 31 for mention of the case.
