The High Court dismissed Ismanira Abdul Manaf’s application to stay her five-year sentence for neglecting her autistic son, Zayn Rayyan
SHAH ALAM: The High Court here today dismissed an application by Ismanira Abdul Manaf to stay the five-year prison sentence imposed on her for neglecting her son, Zayn Rayyan Abdul Matin, two years ago.
Judge Datuk Aslam Zainuddin ruled there were no special circumstances to grant the stay of execution pending her appeal.
“After examining the affidavits of the applicant and respondent, as well as the written submissions of both parties and hearing the oral submissions, the court ruled that the application for a stay of execution be dismissed because the court found that there were no special circumstances to allow it,” he said.
The prosecution was represented by Deputy Public Prosecutors Mohd Izham Ali and Ahmad Iqbal Azman.
Ismanira was represented by lawyers Haresh Mahadevan, Ramzani Idris and Lavanesh Haresh.
The 30-year-old mother filed the stay application on November 19.
On October 31, the Petaling Jaya Sessions Court sentenced Ismanira to five years in prison for neglecting her six-year-old autistic child to the point of causing physical harm.
Judge Dr Syahliza Warnoh ordered the sentence to begin from October 31.
Ismanira was also ordered to sign a two-year good behaviour bond with one surety and a security of RM3,000.
She must perform 120 hours of community service within six months of completing her prison sentence.
