Plastics firm fined RM18,000, orders over RM90,000 sales tax payment

A Melaka plastics company and its directors have been ordered to pay over RM90,000 in unpaid sales tax and penalties, plus an RM18,000 court fine.

MELAKA: The Sessions Court here has ordered a plastics company to pay a total of RM97,965.13 in outstanding sales tax and penalties.

Super Plastic Enterprise Sdn Bhd and its three directors were also fined RM18,000 for three amended charges of failing to pay the tax.

Judge Raja Noor Adilla Raja Mahyaldin imposed a fine of RM1,500 for each charge, with a one-month jail term in default.

The charges relate to unpaid sales tax for three separate taxable periods between October 2023 and March 2024.

The unpaid tax and penalties for the period from October to November 2023 amounted to RM30,797.97 and RM14,319.20 respectively.

For December 2023 to January 2024, the figures were RM28,180.18 in tax and RM15,272.08 in penalties.

The final period from February to March 2024 involved a penalty of RM9,395.70.

The company and directors were found to have failed to pay the amounts at the Royal Malaysian Customs Department office in Ayer Keroh.

They were charged under Section 26(9) of the Sales Tax Act 2018, which carries a maximum penalty of a RM50,000 fine or three years’ imprisonment.

Director Wong Kau Pen, representing the company, requested a lower fine as the business had ceased operations.

Customs prosecuting officer Mohammad Azhar Habib Anuar had requested a fine of RM5,000 for each charge.

He also asked the court to order the repayment of the unpaid sales tax and penalties.
