MyCC issues a proposed decision against 31 Kelantan childcare operators for alleged price fixing, with parties given 30 days to submit representations.
KUALA LUMPUR: The Malaysia Competition Commission has issued a proposed decision against 31 childcare service enterprises in Kelantan for alleged involvement in a horizontal price fixing agreement.
MyCC provisionally found the enterprises infringed Section 4(1) of the Competition Act 2010.
Its chairman Tan Sri Idrus Harun (pic) said investigations revealed the enterprises discussed and agreed to fix floor prices during an association meeting in September 2023.
“The decision reached at the meeting was later communicated to all attendees through a memorandum,” he said.
Idrus added a public announcement was later made via the association’s official Facebook account.
The announcement stated operators had unanimously agreed to fix floor prices effective from 2024.
MyCC found the agreement had the object of significantly preventing, restricting or distorting competition in Kelantan.
Idrus stressed the proposed decision is a provisional finding and not a conclusive determination of infringement.
“The enterprises named in the proposed decision were notified of the proposed penalties and directions today.”
He said they have 30 days from receipt to submit written representations.
The enterprises will also be allowed to present oral representations before the Commission.
MyCC will issue its final decision only after considering all representations and investigation evidence.
