Three former Perlis assemblymen sue speaker over seat vacancies

Three ex-PAS assemblymen file suit against Perlis speaker, challenging the declaration that their state seats are now vacant.

KANGAR: Three former Perlis state assemblymen have filed an originating summons against Speaker Rus’sele Eizan and the State Legislative Assembly.

The plaintiffs are former Chuping assemblyman Saad Seman, Fakhrul Anwar Ismail (Bintong) and Mohd Ridzuan Hashim (Guar Sanji).

They are seeking a court declaration that Rus’sele’s decision to declare their seats vacant was improper, null and void.

The suit, filed at the Kangar High Court, also seeks any other relief deemed appropriate by the court.

Lawyer Mohd Jamil Yaacob of Messrs Srihana Mohamad & Partners is representing the three former representatives.

The Speaker is named as the first defendant and the Perlis State Legislative Assembly as the second defendant.

On 25 December, Rus’sele announced casual vacancies had occurred in the three seats.

He stated the membership of the three PAS assemblymen ceased with immediate effect.

This was done in accordance with Clause (1)(a)(ii) of Article 50A of the Perlis State Constitution.
