AGC defends decision to charge teachers for caning special needs student

The Attorney-General’s Chambers says charges were filed after a thorough review found the teachers acted beyond regulations, protecting the child’s welfare.

KUALA LUMPUR: The Attorney-General’s Chambers (AGC) has defended its decision to charge two teachers for caning a student.

In a statement, the AGC said the decision followed a thorough review of investigation findings which determined they had acted beyond established regulations.

The action aims to ensure the protection of children’s well-being and that no one operates outside legal boundaries.

According to the AGC, the charges were not intended to tarnish the teaching profession.

“They were made after careful consideration of various factors, including the rights and welfare of the student involved, who is a student with special needs (OKU),” read the statement.

The AGC acknowledged the significant role teachers play in educating and shaping future generations.

“This department remains committed to ensuring that every action taken is fair, balanced, and based on legal principles to protect the interests of all parties, especially children and vulnerable groups,” it said.

The two secondary school teachers from Penang were each charged under Section 324 of the Penal Code with voluntarily causing hurt to a student.

They were charged on October 6 at the Magistrate’s Court (2) and (3) in Georgetown, Penang, respectively.

Both teachers previously pleaded not guilty to voluntarily causing hurt to a 15-year-old male student with a cane two years ago.

The offence carries a penalty of up to 10 years imprisonment, a fine, whipping, or any two of these punishments upon conviction. – Bernama
