KPWKM mulls new law to tackle rising homelessness and begging

KPWKM is reviewing the Destitute Persons Act 1977 and considering a new law to address homelessness, begging, elderly welfare and long-term care challenges.

PETALING JAYA: The Women, Family and Community Development Ministry (KPWKM) is reviewing the Destitute Persons Act 1977 and considering drafting a new law to ensure it remains relevant in addressing current social challenges.

In a written reply in the Dewan Negara, the ministry said the move forms part of broader efforts to strengthen social protection and welfare systems for vulnerable groups.

“Among the matters being considered is the drafting of a new Act to replace the existing legislation, taking into account the increasingly complex issues surrounding the growing number of beggars and homeless individuals, including the lack of dedicated shelters for homeless persons with mental health conditions,” it said.

On senior citizens, KPWKM said the government aims to create an elderly population that is independent, dignified and respected through the National Policy for Older Persons and the National Policy for Older Persons Action Plan 2026–2030.

“KPWKM maintains that the best form of care for senior citizens is within the family. Therefore, the ministry continues to emphasise the principles of family-based care and the concept of ageing in place,” it said.

The ministry also highlighted that various social support initiatives are being implemented through the Social Welfare Department (JKM) to safeguard the well-being of senior citizens and enable them to continue ageing in their own homes, with their families and within their communities.

“These initiatives include the Home Help Services programme, Senior Citizens Activity Centres (PAWE), and welfare assistance schemes such as the Senior Citizens Assistance (BWE) and Chronic Bedridden Patients Care Assistance (BPT) for eligible recipients.”

On long-term care, KPWKM said it launched the Malaysia Care Strategic Framework and Action Plan 2026–2030 on Nov 4, 2025, with the goal of training 50,000 caregivers by 2030 through structured and online programmes.

The ministry added that elderly neglect and homelessness are “two distinct social challenges that require different approaches”.

It is also studying the drafting of a dedicated law for senior citizens that would include provisions outlining the responsibilities of children in addressing cases of neglect, abuse and exploitation of older persons.

“KPWKM has conducted a public survey to gather views on the aspirations and expectations of the public regarding the proposed Bill.

“At the same time, engagement sessions are being actively conducted with stakeholders to ensure that the law does not encounter implementation issues once it is gazetted and enforced,” it said.
