The widow of a delivery rider killed in a suspected drug-related crash in Klang plans to file a civil suit for RM1 million in August, pending legal documents.
KLANG: The widow of delivery rider Amirul Hafiz Omar, 33, who was died after being hit by a car driven by a driver believed to have been under the influence of drugs on Jalan Raya Barat here, is expected to file a RM1 million civil suit against the accused in August.
Lawyer Nur Iffah Hizwani Omar said a writ of summons and statement of claim had been prepared on behalf of the victim’s widow, Nor Nadia Abdul Majid, 32, but filing is pending the issuance of the Letter of Administration.
She said the application for the Letter of Administration, filed at the Kuala Lumpur High Court, is expected to be decided on July 28 before the legal team obtains documents on the deceased’s supplementary income from an e-hailing company.
The supplementary income records are required to determine the amount to be claimed in the statement of claim before the suit is filed at the Shah Alam High Court.
“So far, I have received instructions from our client to pursue a claim amounting to RM1 million. If there are no obstacles, the writ of summons and statement of claim are expected to be filed in August,” she said when met by the media at the Klang Court Complex here today.
Meanwhile, Nor Nadia said she has assumed the responsibilities previously shouldered by her late husband after nearly four months of coping with his loss.
“It was only after three months that I truly felt the sadness and loss. Before that, it felt as though my husband had simply gone to work as usual. Only now do I realise the grief is becoming more overwhelming,” she said.
She said the grief deepens whenever she looks at her children, as they remind her of her late husband’s sacrifices and his daily routine of sending them to school and bringing them home.
“Whenever I look at my children, I feel sad. I remember how hard my husband worked to raise them. He used to send them to school every morning before picking them up at noon so they could have lunch together. Rain or shine, he never failed to fetch them. Now I have taken over that responsibility,” she added.
On April 1, R. Saktygaanapathy, 28, was charged at the Klang Magistrate’s Court under Section 302 of the Penal Code with the murder of delivery rider Amirul Hafiz Omar, 33, over an incident on Jalan Raya Barat here on March 29.
No plea was recorded on the murder charge as it falls under the jurisdiction of the High Court
He later pleaded not guilty on June 3 to an amended charge under Section 15(1)(a) of the Dangerous Drugs Act 1952 for self-administering tetrahydrocannabinol (THC).
