KUALA LUMPUR (Jan 7, 2014): Actor and comedian Mohd Yazid Lim Mohamad Aziz (pix), popularly known as Johan Raja Lawak has won a suit against a drama director and a film production company over the injuries he suffered during a discussion at a resturant four years ago.
In allowing the suit filed by Mohd Yazid and his wife, actress Rozlinawaty Ismail or better known as Ozlynn Wati, Judge Datuk Su Geok Yiam also ordered the defendants, Mohd Javed Mohd Nizar and Juara Filem Sdn Bhd, to pay damages and costs, which would be decided on Jan 23.
The court also rejected the RM2 million countersuit filed by Mohd Javed, 37, and the production company.
On July 18, 2010, Mohd Yazid, 29, and Rozlinawaty, 32, filed a RM1 million suit against the defendants, claiming that Mohd Javed had assaulted and hurled a drinking glass at Mohd Yazid, which caused him to suffer injuries on the forehead, when they met for a discussion at a restaurant in Sikamat, Seremban, Negeri Sembilan on May 11, 2010.
In the statement of claims, Mohd Yazid, who is also a radio deejay, claimed that Mohd Javed flipped their table in anger and that he (Mohd Yazid) was also punched in the eye by a production crew member known only as Halim.
Mohd Yazid claimed that Mohd Javed and Halim continued to hit and kick him, and when Rozlinawaty tried to stop them, she was also assaulted.
The comedian also claimed that the director had written and sent a defamatory e-mail against them to the Malaysian Artiste Association on May 20, 2010.
Mohd Yazid claimed that the words used by Mohd Javed in the e-mail implied that he was unfit to be hired as actor, was always late, uncooperative and was a problem maker to the extent of being fired from the drama production.
The actor claimed that the day prior to the incident (May 10), his mother, Salwa Md Dani, died of a brain tumour, and that he and his wife had to make funeral arrangements and could only arrive at the filming location at 4pm the following day.
The two plaintiffs demanded RM1 million in general damages, together with special damages, costs and other relief deemed fit by the court.
They also demanded the two defendant make a public apology through local print and electronic media, as well as to withdraw the defamatory e-mail. – Bernama
