Gagal lapor rasuah, pengarah syarikat didenda RM20,000

MELAKA: Mahkamah Sesyen Ayer Keroh di sini hari ini mendenda seorang pengarah syarikat RM20,000 atas kesalahan gagal melaporkan pemberian suapan daripada seorang kontraktor projek, tahun lepas.

Hakim Elesabet Paya Wan menjatuhkan hukuman itu selepas tertuduh Azrul Rizad Othman, 47, mengaku bersalah atas pertuduhan pilihan yang dibacakan jurubahasa mahkamah, dan turut mengarahkan penjara enam bulan sekiranya gagal bayar denda tersebut.

Azrul Rizad sebagai pemilik perniagaan Mediaworks Design didakwa telah diberikan suapan berupa wang tunai RM3,000, oleh seorang individu yang merupakan kontraktor projek di sebuah kafe di Jalan Kota Fesyen Ayer Keroh, dalam daerah Melaka Tengah pada 18 Sept 2024.

Suapan tersebut sebagai dorongan supaya perniagaan milik tertuduh yang dilantik menjadi perunding bagi kerja membina sebuah rumah teres satu tingkat jenis kekal di Jalan Sungai Air Hitam, Tanjung Minyak bernilai RM1.9 juta, mengesyorkan sebuah syarikat kontraktor bagi melaksanakan kerja tersebut.

Jika sabit kesalahan, lelaki itu boleh didenda maksimum RM100,000 atau penjara tidak melebihi 10 tahun atau kedua-duanya mengikut Seksyen 25(1) Akta Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) 2009 dan Seksyen 25(2) akta sama, kerana gagal melaporkan pemberian suapan kepada pegawai SPRM atau polis.

Terdahulu, Timbalan Pendakwa Raya Sharina Farhana Nor Sa’ari memohon satu denda yang maksimum dikenakan sebagai pengajaran dan bagi menjaga kepentingan awam.

Bagaimanapun peguam Azrul Zulkifli Stork yang mewakili Azrul Rizad, memohon satu bentuk hukuman tanpa pemenjaraan dikenakan, memandangkan anak guamnya mempunyai tanggungan keluarga termasuk isterinya yang tidak bekerja.

Mahkamah turut mengarahkan wang tunai RM3,000 yang disita dikembalikan kepada SPRM, manakala pertuduhan di bawah Seksyen 16(a)(A) Akta SPRM 2009 diambil pertimbangan selaras peruntukan Seksyen 171A Kanun Tatacara Jenayah.
