Two directors of Seng Cushion Sdn Bhd face 58 charges for failing to pay sales tax and penalties totalling RM320,337.84 between 2019 and 2024.
GEORGE TOWN: Two directors of a furniture company pleaded not guilty to 58 charges of failing to pay sales tax and penalties totalling RM320,337.84.
Ng Eng Chen, 64, and Lim Paik Eng, 62, entered their pleas at the Sessions Court here before Judge Irwan Suainbon.
The charges relate to the taxable period between 2019 and 2024. They were charged in their capacity as directors of Seng Cushion Sdn Bhd.
According to the charge sheets, the company and directors allegedly failed to pay sales tax of RM228,812.83. This sum includes penalties of RM91,525.01 imposed by the Director-General of Customs.
The offences were allegedly committed at the Customs Department Complex in Seberang Jaya. They are charged under Section 26(5) of the Sales Tax Act 2018.
Upon conviction, they face a fine of up to RM50,000 or imprisonment of up to three years, or both. This is stipulated under Section 26(9) of the same Act.
The prosecution was conducted by Customs prosecuting officer S. Bakialetchumy. Both accused were unrepresented during the proceedings.
The court fixed April 10 for mention. This date is for the submission of documents and the appointment of legal counsel.
