On August 6, Ain Husniza’s lawyer, Datuk Sankara Nair, said she will file a RM5 million counter suit after receiving a RM1 million defamation suit.

The counter suit will be filed on the basis that Ain Husniza has been subject to emotional distress. Ain has appeared at the police station for questioning looking scared and nervous.

Despite her nervousness, she said the police investigations will not deter her from speaking out or to continue her mission to make schools a safer place.

“I was very nervous and scared, as much as any 17-year-old would feel, when I was called in by police. All I want is the feeling of safety in schools,” she said.

“I did not intend to insult, defame or degrade any party. All I want is for schools to be safe.”

“It is our right as students to have safety in schools and it is what I’m fighting for right now,” she added.

According to her lawyer, the police are investigating Ain Husniza under Section 504 of the Penal Code for intentionally insulting with the intent for such provocation to threaten public peace. If she’s found guilty, she faces imprisonment for up to two years, or a fine, or both.

Ain went viral in April 2021 when she called out her teacher for making rape jokes in class. To date, Ain and her family have not revealed the teacher’s name. According to several local reports in May 2021, the teacher is said to have been transferred to the Selangor State Education Department and would remain there until police investigations against him are completed.

The physical education teacher alleged that the family’s defamatory claims has caused him emotional distress and finds it hard to face the public. He said their statements are not only false but have ruined his reputation.

In the same letter of demand, he demanded Ain Husniza and her parents to refrain from making statements against him, retract the statements they have already made, apologize for the statements that were made, and to promise not to make such statements again.
